The report on the alleged use of European countries by the CIA for the transportation and illegal detention of prisoners (Fava Report, 2007 INI) and the subsequent Parliament resolution on 14 February 2007 urged the EU institutions and the member states to take action to shed full light, acknowledge, repair and prevent in the future the human rights violations that occurred in Europe in the context of the US rendition and secret detention programmes. In particular this resolution called on the EU to recall the full application of the "democratic clause", to promote within the UN framework codes of conductfor all security and military services; and also asked the European countries to establish clear rules that provide the possibility to waive State immunity where illegal actions violate human rights. The resolution underlined the importance of a common definition of terrorism, called the closure of Guantanamo and the establishment of efficient legal tools for combating terrorism within the framework of international law. The EP resolution established that the EP is expected to be fully informed about all developments and instructed LIBE to follow up politically the proceedings and to monitor the developments.
